Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Sunnyside, a kitchen display system for venues using Square POS (the “Service”). By creating an account or using the Service you agree to these Terms on behalf of yourself and, where applicable, the business you represent. If you do not agree, do not use the Service.

1. The Service

Sunnyside receives order information from your connected Square account and displays it in real time on kitchen screens that you pair to your account. The Service includes the owner dashboard, the kitchen display application, and related features such as display configuration, device pairing, and order analytics.

The Service depends on third-party platforms — in particular Square (for point-of-sale data) and Stripe (for billing). We are not responsible for outages, changes, or limitations of those platforms, though we will make reasonable efforts to keep the Service working with them.

2. Accounts

You must provide accurate account information and keep your password secure. You are responsible for all activity that occurs under your account, including on paired kitchen devices. Notify us promptly at support@example.com if you suspect unauthorised access. You must be at least 18 years old and authorised to bind the business you connect to the Service.

3. Fees and billing

The Service is offered on a single paid plan of $10 AUD per active location per month (plus any applicable taxes), billed as a subscription through Stripe. Your subscription quantity equals the number of locations you keep active; deactivating a location reduces the billed quantity on the next sync. Promotional codes, where offered, are applied through Stripe and subject to their stated conditions.

Prices may change with at least 30 days’ notice by email; continued use of the Service after a price change takes effect constitutes acceptance of the new price.

4. Refunds and cancellation

  • You may cancel your subscription at any time via the Stripe billing portal, accessible from the Billing page of your dashboard.
  • Cancellation takes effect at the end of your current billing period. You retain access to the Service until then.
  • We do not provide refunds or credits for partial billing periods, unused time, or downgrades (for example, deactivating a location mid-cycle), except where required by law — including the Australian Consumer Law.
  • Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.

5. Acceptable use

You agree not to:

  • use the Service in violation of any applicable law;
  • attempt to access data belonging to another merchant, interfere with or disrupt the Service, or probe its security;
  • resell or sublicense the Service without our written consent; or
  • reverse engineer the Service except to the extent permitted by law.

6. Your data

You retain ownership of your business data (order information, location names, display configurations). You grant us a licence to host, process, and display that data solely to provide the Service. Our handling of personal information is described in the Privacy Policy.

7. Availability and support

We aim to keep the Service available at all times and will make reasonable efforts to maintain uptime, but the Service is provided on an “as is” and “as available” basis without a guaranteed service level. Order display depends on your internet connection, your devices, and Square’s systems. Sunnyside is a display aid — it is not a system of record. Always confirm orders against your Square account. 8. Limitation of liability

To the maximum extent permitted by law (and subject always to the consumer guarantees in the Australian Consumer Law):

  • we are not liable for indirect, incidental, special, or consequential loss, loss of profits, loss of revenue, or loss of data arising from your use of the Service — including loss arising from orders that fail to display, display late, or display incorrectly; and
  • our total aggregate liability in connection with the Service is limited to the amount of fees you paid to us in the 12 months preceding the event giving rise to the claim.

Where liability under a consumer guarantee cannot be excluded but can be limited, our liability is limited (at our option) to resupplying the Service or paying the cost of having it resupplied.

9. Suspension and termination

We may suspend or terminate your access if you materially breach these Terms, if your subscription payment fails and is not remedied, or if required by law. You may stop using the Service and delete your account at any time by contacting support@example.com. Sections that by their nature should survive termination (including fees owed, limitation of liability, and governing law) survive.

10. Changes to these Terms

We may update these Terms from time to time. For material changes we will give you at least 14 days’ notice by email or through the dashboard. Continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.

11. Governing law

These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia.
